ROAD VACATION
NOTICE IS HEREBY GIVEN pursuant to Utah Code Annotated 72-3-108 that a public hearing will be held concerning a petition to vacate the southernmost part of 3300 West from where the pavement ends and rights-of-way in the 2800 West and 4000 North area of unincorporated Box Elder County.  The public hearing will be held on the 19th day of June 2013, at 5:20 p.m. in the Commission Chambers at the Box Elder County Courthouse, 01 South Main Street, Brigham City, Utah 84302.  If you have any questions, please contact Community Development Director Scott Lyons at 734-3316.

NOTICE OF TRUSTEE’S SALE
The following described property will be sold at public auction to the highest bidder, payable in lawful money of the United States at the time of sale, at the front/east entrance of the First District Court building located at 43 North Main Street, Brigham City, UT  84302, on June 24th, 2013 at 2:00 p.m. of said day, for the purpose of foreclosing a trust deed originally executed by NICKANORA M. The current beneficiary of the trust deed is United States of America, acting through the Rural Housing Service and the record owners of the property as of the recording of the notice of default are NICKANORA M. SMITH.
Said Sale will be made without covenant or warranty, express or implied, regarding title, possession, condition, or encumbrances, including fees, charges, and expenses of the Trustee and of the trusts created by said Trust Deed, to pay the remaining principal sums on the note secured by said Trust Deed.
Bidders must be prepared to tender payable to the Trustee, $5,000.00 in certified funds at the sale and the balance of the purchase price in certified funds by 2:00 P.M. the following business day.  CASH PAYMENTS ARE NOT ACCEPTED. A net recovery value bid of approximately $49,000.00 will be entered in behalf of the lender at the sale.  The trustee reserves the right to void the effect of the trustee’s sale after the sale, based upon information unknown to the trustee at the time of the sale, such as a bankruptcy filing, a loan reinstatement, or an agreement between the trustor and beneficiary to postpone or cancel the sale. If so voided, the only recourse of the highest bidder is to receive a full refund of the money paid to the trustee. A Trustee’s Deed will be delivered to the successful bidder within three business days after the receipt of the amount bid.
